Welcome to Whisper Win, operated by Caesium Studios. By downloading, accessing, or using our app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

1. Acceptance of Terms

By clicking "I Accept," creating an account, or using Whisper Win in any manner, you:

• Confirm you have read, understood, and agree to these Terms

2. App Purpose & Disclaimers

3. Eligibility & Age Requirements

• If you are under 18, you are prohibited from using this app

4. User Accounts

• Illegal activities or content that violates applicable laws

• Threats of violence, terrorism, or harm to individuals or groups
• Self-harm promotion, suicide instructions, or pro-eating disorder content
• Non-consensual intimate images or revenge content
• Spam, malware, phishing attempts, or malicious code
• Copyright infringement or unauthorized intellectual property use
• Doxxing or sharing private personal information without consent
• Content promoting dangerous or illegal substances
• Graphic violence or disturbing imagery

6. User Conduct & Responsibilities

You agree to:

• Use the app respectfully and in accordance with these Terms
• Respect other users' privacy and dignity
• Report violations through our in-app reporting system
• Not attempt to circumvent security measures or access restrictions
• Not use automated tools, bots, or scripts without authorization
• Not engage in commercial activities without explicit permission
• Not impersonate others or create fake personas

7. Content Ownership & Licensing

Your Content:

• You retain ownership of content you post
• By posting, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the app's functionality
• You represent you have all necessary rights to post your content
• You remain responsible for your content and its compliance with these Terms

Our Content:

• All app features, design, code, and functionality are owned by Caesium Studios
• You may not reproduce, modify, or distribute our content without explicit written permission

8. Content Moderation & Enforcement

• We actively monitor and moderate content using automated systems and human review
• We reserve the right to remove any content that violates these Terms
• Users can report violations through our in-app reporting mechanism
• We will investigate reports promptly and take appropriate action

• Any content involving minors in inappropriate contexts will result in immediate account termination and law enforcement notification

Whisper Win is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We specifically disclaim:

• Warranties of merchantability, fitness for particular purpose, or non-infringement

• Accuracy, reliability, or completeness of user-generated content
• Effectiveness of content moderation or security measures

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Caesium Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for all claims shall not exceed $100 or the amount paid by you (if any) in the 12 months preceding the claim
• We are not responsible for user-generated content or actions taken by other users
• You use the app at your own risk and discretion

15. Copyright & DMCA Policy

We respect intellectual property rights. To report copyright infringement:

• Repeat infringers may have their accounts terminated
